On those grounds, Nintendo should just fix it or swap it for you for nothing. I reckon they will if you're nice and explain the situation to them. Aspects of quality include fitness for purpose, freedom from minor defects, <strong>durability</strong> and safety. <br/> <br/>The only trouble is I have to prove it wasn't fit for purpose. But I think the good condition the of the DS does that.
